1. What are the hours of the Planning and Zoning Department?

We are open Monday through Thursday, 7:00 am to 6:00 pm. We are closed for all federal holidays.

2. How do I get to your location?

The Planning and Zoning Department is located at 1246 County Road 16 in Fairplay.

County Road 16 is located East of Highway 285. Traveling from Denver on Highway 285, turn left just before the Grub N Stuff gas station. If traveling toward Denver on Highway 285, you would turn right just after the Grub N Stuff gas station.

Environmental Health, Building, GIS, Historic Preservation and the Planning and Zoning Department are all located at 1246 County Road 16.

3. How can I find out how a property is zoned?

The property type on the Assessor’s website is not the same as the zone district. Please send an email, call (719) 836-4254, or fax (719) 836-4351 with a legal description, address, and/or tax schedule number, and the full name of the property owner for the property in question to verify your zone district for building.

4. What are the required building setbacks?

Setback requirements can be found by calling (719) 836-4254.

Note: Some Planned Unit Developments(PUDs) have specific setback requirements.

5. How can I obtain a copy of the Park County Land Use Regulations (LURs)?

You can come into our office in Fairplay to purchase a CD copy for $10 or request pages of specified information to be faxed, mailed, or e-mailed. Hard copies are $0.25 per page. LURs can also be viewed and downloaded from Land Use Regulations.

6. Can I live on my property during the construction of my primary residence?

Yes. You must complete a Construction Dwelling Registration form and submit it to the Planning Department when applying for your building permit for a primary residence. Please be sure to read the requirements for a Construction Dwelling.

7. How long is the Planning and Zoning Sheet valid?

The Planning and Zoning Sheet is valid for six months.

8. If I am putting in a driveway, do I have to complete the same paperwork as if for a residence?

Yes, the same paperwork is required regardless of the type of permit applying for. This includes a Planning and Zoning Sheet; copy of a recorded warranty deed; a completed plot plan with setbacks, measurements, dimensions; and locations of existing and proposed structures, well, septic, leach field, and driveway.

9. Can I camp on my property?

Yes, as long as you do so for less than 6 months a year, do not permanently affix the camping unit to the ground, and do not leave the camping unit on the lot for more than six months of any given year (unless the lot is equal to or larger than 35 acres.) 10. Can I have horses on my property?

Regardless of zoning, the property must have a lawful source of water or well permit that authorizes the watering of livestock. Property must be routinely cleared of waste products. All corrals, stalls, and barns shall be located 50 feet from any dwelling, and 100 feet from any water well or watercourse. Runoff containing organic waste shall not be allowed to drain onto adjacent lots or any watercourse.

If your property is zoned Agricultural (A), there are no restrictions on the number of horses and/or any large livestock other than federal and State Animal Feed Operations (AFO) and Confined Feed Operations (CFO) regulations. Please refer to the Park County Land Use Regulations, Article 5, Division 7, Section 5-700 for the current Animal Regulations.

Please note: For properties that were created after August 23, 2003, and are less then 10 acres, no large livestock animals are permitted.

11. Can I build a storage shed (accessory structure) on my property if it is vacant land, and if so, do I need a building permit?

Yes. If your property is 35 acres or larger you may. If your property is less than 35 acres, you may not, until you have a primary residence on the property, or obtain a building permit for a primary residence.

Please note: An accessory structure may not be occupied as a dwelling. Even though the accessory structure may or may not need a building permit, it must meet the current setbacks associated with your zone district and the current building code..

12. Are there any size restrictions for a residential structure?

There is no minimum square footage requirement, and the building height shall not exceed 35 feet.

13. Can I subdivide my property into several lots?

14. Can I put a mobile home on my property?

No. Park County does not allow mobile homes to be used as a primary residence or accessory building in any zone district except for the mobile home park zone districts.

15. How can I file a complaint pertaining to a land use violation?

Please call the Park County Code Enforcement Officer at (719) 836-4262 for more information. A Formal Complaint Form must be completed and submitted to the Park County Code Enforcement Officer before any investigation can be started.

16. Who is responsible for culvert maintenance?

If the culvert is under a driveway, the responsibility belongs to the homeowner. If the culvert is under a county road, responsibility belongs to Park County Road and Bridge.
